By signing below, I hereby confirm that I have carefully read this Waiver of Liability and Indemnity (at the bottom of the page) and fully understand all of its contents, and their legal effect. I agree that this Waiver of Liability and Indemnity is contractually binding, and that I am signing it on my own free will. I also hereby agree, on behalf of my child or ward, to all of the terms of such Waiver of Liability and Indemnity, and hereby give my permission to my child or ward to visit the Masai Mara National Reserve. I also acknowledge the details given above as true to the best of my knowledge.

WAIVER OF LIABILITY AND INDEMNITY

1. I acknowledge that there are certain risks associated with my visit to Roca River Camp and The Masai Mara National Reserve including risks associated with being in close proximity to wild and unpredictable animals, unpredictable weather and rough terrain. I therefore undertake this visit to any property within Roca River Camp and The Masai Mara National Reserveentirely at my own volition and risk.

2. I confirm that I have been briefed about the risks associated with my visit to Roca River Camp and The Masai Mara National Reserve.

3. I have understood and hereby accept the risks inherited in and associated with my visit to Roca River Camp and The Masai Mara National Reserveincluding but not limited to any risks that may arise from negligence or carelessness on the part of Roca River Camp and The Masai Mara National Reserve, its agents, employees and officers (the “Released Persons”). I have also understood and hereby accept the risk arising from any equipment or property owned, maintained, or controlled by the Released Persons.I understand that I have a duty to exercise reasonable care for my own safety, and I agree to do so.

4. I understand that the owners and managers of the Roca River Camp and The Masai Mara National Reserve together with their employees,agents and independent contractors are not liable, in any way for the loss of or damage to my property, or for any personal injury to me or any member of my party for whom I am responsible,however this maybe caused, and whether it occurs within the precincts of Roca River Camp and The Masai Mara National Reserveor while I engage in excursions or activities outside the precincts of Roca River Camp and The Masai Mara National Reserveand that are organized by Roca River Camp and The Masai Mara National Reserve,its agents, employees and officers(the “Released Persons”), such as, but not limited to, walking or travelling in motor vehicles. For the avoidance of doubt, this waiver covers visits organized by Mobile Expeditions to the Masai Mara National Reserve areas or any other areas within the Masai Mara.

5. In addition, I hereby waive any right that I have or may have to bring any claim, suit or proceedings against Roca River Camp and The Masai Mara National Reservetogether with their employees, agents and independent contractors, whether such claim,suit or proceedings are founded in statute, contract, equity, tort or otherwise, related in any way to any illness, accident,injury,death, damage, theft to loss suffered by me or my property,that may arise directly or indirectly from this visit and/or my participation in any activities within Roca River Camp and The Masai Mara National Reserve.

6. I hereby indemnify, release and hold harmless the Roca River Camp and The Masai Mara National Reserveand its respective owners, directors,operators, management, employees, staff, agents and associates from all liability, blames and responsibility,whether direct or indirect, arising from any illness, injury, theft, loss or death that I may suffer now or in the future.

7. This waiver is entered into on my behalf and on behalf of any minor accompanying me, and shall be binding on my assigns, heirs and legal representatives and on those of any minors accompanying me, and I fully understand that by signing this waiver I release Roca River Camp and The Masai Mara National Reserve their respective employees, agent and officers from any culpability or liability on the terms set out in this waiver. I confirm that I have executed the necessary consent permitting my child to visit the Roca River Camp and The Masai Mara National Reserve.

8. If any portion of this waiver is unenforceable, such portion shall be struck out provided that the remaining portion shall remain in full force and effect.

9. This waiver and any rights, duties and obligations as between the parties to the waiver shall be governed by Kenyan law.

10. The Parties shall endeavor to settle amicably any dispute arising from this waiver, and any dispute that cannot be resolved amicably within 30 Days after either party's request to the other for resolution of the dispute through negotiated settlement or mediation shall be referred to Arbitration by an arbitrator appointed by the current Chairman of the Chartered Institute of Arbitrators, Kenya Chapter. The place of Arbitration shall be Nairobi and the language of Arbitration shall be English. For the avoidance of doubt, either Party will be entitled to interim injunctive relief from the High Court of Kenya.
